I represent my father, Mr. Robert J. Donovan, and his interest in the estate of his eldest brother Mr. Daniel W. Donovan. Furthermore my brother Kevin Michael submitted a petition to the court to contest both potential executors and execute Uncle Daniel's estate in testate to all six of his brothers and sisters equally.
I am the closest living relative to Uncle Daniel. We met personally, often daily, starting over seven (7) years ago. His closest relation for almost three decades was to a woman I called 'Aunt' Loaraine. Miss Roberts was Uncle Daniel's domestic partner and followed him not to long ago, about a year after he passed away.
Before she passed 'Aunt' Lorraine and I visited by telephone and in person often and at length. She had a lot to say about Uncle Daniel, his estate and what should rightly be considered. Thank God she summoned the courage to confront Uncle Bill's attorney back in January.
William Paul Donovan, Uncle Bill, is Uncle Daniel's next younger brother; Uncle Daniel's siblings including himself in the following order are:
Danny, Billy, James, Richard, Robert, Eileen, and Dottie.
Mr. Aaron C. Gregg represents Uncle Bill. He phoned in an appearance that morning back in January. Judge Cantor came to understand that Uncle Daniel even had a domestic partner, something that had not been communicated between Mr. Gregg, the Probate Court, and Uncle Bill. Aaron and Uncle Bill had failed to include her in any correspondence as either a potential heir or rightful claimant to Uncle Daniel's estate.
Her attendance that day led to numerous continuances. As more and more shenanigans were revealed, the true intentions of both Uncle Bill, his attorney Mr. Gregg, and the Trioka of Mr's. Beinert, Church, and Harris have not gone unnoticed, unprotested, nor unknown to my father. He rightly regards both groups with disdain.
A long time ago Uncle Daniel enlisted in the United States Marine Corps sometime in the Fifties, where he served for a short while. He was injured in the line of duty; having lost his spleen the Corps discharged him honorably and granted a line of duty determination. The Veterans Administration accepted the Corps’ determination and awarded him a disability rating of somewhat less than one hundred percent (< 100%). His partial award was immediately paid and continued to be paid with yearly COLAs to be disbursed every month until his death.
That’s a lot of money for someone who in the last decades of his life had no payment obligations. He saved that money; His Life Savings.
Uncle Danny was admitted for the last time into the VA in West Los Angeles in 1975 to begin sobriety. From that year forward he re-dedicated his life to serving the Lord. It was an avocation he’d pursued since childhood. His efforts were blessed by a Roman Catholic Bishop and he was eventually granted the title ‘Pastor’. As the years passed by he was able to find, gather, and graduate fellow persons like himself to sobriety. They joined him in being of service to a power greater than them selves. They called their group, ‘The Fellowship of the Holy Spirit.’ It still exists today in West Los Angeles.
As members matured and went on to serve others they needed less direct sponsorship from Uncle Daniel. The Lord put plenty more souls to save that benefited from Uncle Daniel’s selfless sacrifice. Those who graduated usually married or repaired their broken unions and moved on to become productive members of society. They would begin to repay what had been freely given to them. They numbered in the thousands and some would stop by from time to time to thank him for always speaking to the truth. Uncle Daniel never failed to point heaven ward and reply, “Thank God.” He never took credit for HIS work.
He was often heard, “You do the asking, but God does the doing!” And near the end of his life he kept some of the fellows of the Holy Spirit. Many wanted to marry and move on but this last group was impressed by Uncle Daniel’s dedication to celibacy, service, and prayer. The Troika of John, Keith, and Danny were influenced by his example and remain to this day dedicated to their understanding of my Uncle. These three men are celibate, unmarried, and monastic.
Their work is mostly good, some bad, and in the case of executing Uncle Daniel’s estate dead wrong.
Their (the Trioka & Uncle Bill) primary motivation has been and is to make sure that Uncle Daniel's estate remained out of the hands of his rightful heirs. They have done so by dismissing the status of some of Uncle Daniel's siblings including my father as well as his domestic partner. Uncle Bill has lied to the court when he says he represents my father. He does not. He started his charade on the day Uncle Daniel died.
When Uncle Danny died his brother Bill and sister-in-law Barbara drove immediately from Yorba Linda to Santa Maria. They arrived that day and stormed into Uncle Daniel's home on East Boone. They went to Uncle Danny’s room making dismissive comments to those in attendance. Uncle Bill and Aunt Barbara gathered up as many papers as possible and left, telling those in attendance, "There's nothing of value here." They repeated this same lie shortly thereafter to all six of Uncle Daniel's siblings. This was done even though they both knew of the existence of two accounts at two seperate institutions. One had petty cash in the thousands for charitable funds, the other had Uncle Daniel's Life Savings in the tens of thousands of dollars.
As the arrangements for the funeral procedded, Uncle Bill made it be known that the arrangements were his and his alone to decide. He named himself next of kin on the death certificate and on the Veterans Administration death benefit form. He told everyone he was going to pay all expenses because he could afford to and they couldn't. This was a 'magnanamous' offer for someone who wouldn't be able to collect reimbursement from Uncle Daniel's estate, because, "There's nothing of value here." When in fact the truth is Uncle Bill propped up his stature all the while knowing he'd be reimbursed handsomely and none of the family and friends would have been the wiser.
As the months passed he has defrauded the court by asking for recompennse of the funeral expenses from Uncle Daniel's estate. In the mean time he has asked for and possibly received reimbursement monies from 'Aunt' Lorraine, the Trioka, and his brothers and sister. It is known that his other sister Dottie has all ready reimbursed him for one-half. And yet he has not ammended his claim against the estate for the full amount of the funeral expenses.
Furthermore Uncle Bill has failed to represent Uncle Daniel's wishes. Uncle Bill has told his brothers and sisters on many occasions that Uncle Daniel's estate would be disbursed equally between Uncle Daniel's siblings. All the while he was writting to and telling 'Aunt' Lorraine, the Trioka, and other members of the Fellowship of the Holy Spirit that he was going to execute Pastor Daniel's 'Document' towards some unknown and unnamed benefactor that fits with the Trioka's blessings.
The 'Document' that has been refered to as a will is a fraud. It was conceived and executed to paper by Uncle Daniel under duress. The draft was such a horrible composition that it had to be rewritten by Mr. Beinert who passed around the 'Document' rewrite to the interested parties. His version was what was first presented to the interested parties. Members of the Fellowship of the Holy Spirit to include the Trioka cornered Uncle Daniel in his private quarters just before his passing. They entered late with the intent to take from a declining man his Life Savings. They emerged from his bedroom with a 'Document' that was composed and signed with undue influence and under duress. Uncle Bill knows this and has perpetuated this fraud. He has been told by more than one person the circumstances surrounding the creation of the 'Document'.
In fact, Uncle Daniel rectifiied the problem by transferring the Life Savings out of the instituion referred to in the 'Document' to a different instituion. In opening the new account for his Life Savings he conspicuously declined to name Mr. Beinert or Mr. Church as co-signers. Uncle Daniel left the charitable fund account alone. This was done expressly to rectify the situation the Trioka and others had perpetuated on him. More than one person, including his domestic partner, attested to Uncle Daniel's reason for moving the money to a new instituion in the months before he passed away.
It is Uncle Danny's Life Savings that are being contested. The Trioka are perpetuating a fraud on this court by insisting that Uncle Danny collected monies that were never disbursed. Uncle Danny was an honorable man. His memory and my integrity demand that his record of handling charitable funds not be impuned with The inferred slander.
I would not let this court, the Trioka of Mr Bienert, Mr. Church, & Mr. Harris and/or Uncle Bill infer that my Uncle Daniel took tens of thousands of dollars from hundreds and thousands of persons over months, years, and decades and never forwarded any and all receipts to the promised agencies of charitable works around the world. The obvious implication is Uncle Daniel took money and never handed it out. This is outrageous!
As for the Trioka and Uncle Bill, what was theirs was theirs, and for Uncle Daniel what was his was his. Uncle Daniel has Six rightful heirs; His six brothers and sisters are all still alive. After Uncle Daniel's estate is executed to these six beneficiaries, then and only then, may the Trioka ask for donations to their cause from his right full heirs.
Not before!
As for Uncle Bill, he may not rightfully claim funeral expenses all ready reimbursed. Those who reimbursed him should petition the court directly with their claims. Nor should he claim attorney's fees for expenses incured in perpetuating a fraud on the Probate Court of the County of Santa Barbara in Santa Maria.
